To secure your wedding date in our diary, a £100 deposit is required. This deposit is non-refundable and non-transferable, to cover costs incurred prior to making your cake e.g. emails, phone calls, drawing up sketches and quotes, time spent researching specific elements of your cake design etc. Your deposit is taken off the balance of your quote. The remaining balance is due eight weeks before your wedding. This can be paid by BACS (details on customer order form) or by card in our showroom. Unfortunately we cannot take card payments over the phone. If the final payment isn’t received, a reminder will be sent. If payment still isn’t received, we will consider the order cancelled.
Any changes to your original cake design must be confirmed no later than eight weeks before your wedding. Changes to the previously agreed design may incur extra charges.
We strongly advise couples take out wedding insurance.
Cancellation by the customer: If the order is cancelled, the £100 deposit is non-refundable to cover time and costs already incurred e.g. emails, phone calls, quotes, sketches, time spent researching specific techniques and/or materials. Orders cancelled within 3 months of the wedding date will be invoiced 50% of the total balance. This is to cover lost earnings as Charlotte Wilcox Cake Design will have turned away other business for the same date and it’s very unlikely the date could be filled by a new customer at such short notice. If the order is cancelled within a month of the wedding/event date, the full payment will be retained.
Cancellation by Charlotte Wilcox Cake Design: In the event of exceptional circumstances such as serious illness, we will give as much notice as possible if we are unable to fulfil your order. We will endeavour to help find another cake designer to fulfil your order and refund any monies already paid.
Force Majeure Clause: Charlotte Wilcox Cake Design will not be liable for any failure to provide services where such failure is outside our reasonable control, including but not limited to earthquake, flood, fire, storm, snow, adverse weather conditions natural disaster, act of God, war, terrorism, armed conflict, labour strike, lockout, boycott, mechanical breakdown, traffic congestion or other similar events.
Covid-19: If your event is unable to go ahead due to government restrictions surrounding Covid-19 and you wish to postpone your order, both parties must agree to the new proposed date. A new deposit will not be required but your order may be subject to a price increase. This would be communicated prior to securing the new date. If the event is postponed to a date we can’t accommodate, the deposit would be non-refundable to cover work already carried out. If we are required to close Charlotte Wilcox Cake Design due to government restrictions surrounding Covid-19 and are therefore unable to fulfil your order, we will refund any monies paid over the deposit.
Delivery and Set-up
Wedding cake orders over £400 are delivered free of charge within a 20 mile radius of DN10 6JH. Orders below this value or further afield will be subject to a mileage charge of 80p per mile, round trip to cover fuel costs and time.
Upon delivery to the venue, responsibility for the cake passes to the venue/customer. A delivery/set up information sheet will be given to a member of staff with specific instructions and allergy information. The member of staff will be asked to sign our copy to confirm the cake has been delivered in good condition. We strongly advise that stacked wedding cakes are delivered and set up by Charlotte Wilcox Cake Design. We endeavour to deliver within the given time slot by the wedding venue but cannot be held responsible for delays due to traffic congestion, mechanical failure etc. In the event that we are delayed, we will endeavour to deliver the cake as close as possible to the given delivery time.
Any orders collected from Charlotte Wilcox Cake Design are the sole responsibility of the customer as soon as they leave our premises. The cake should be placed on a flat surface in your vehicle e.g. the boot (not a slanted car seat) and be clean and tidy. We advise driving slowly and carefully. Non-slip matting is particularly useful for helping keep the cake in place.
Please carefully consider where your cake will be displayed. Cakes placed outside or next to windows in full sun are liable to react to the temperature. Hot or humid weather can affect the icing and decoration. We are happy to advise on placement. Our recommendation is that half of each flavour is cut and served then if guests are still eating, serve another quarter. This means any cake left over is in good size pieces to wrap in foil and save for up to three days at room temperature or put in the freezer for up to three months. We cannot be held responsible for the entire cake being cut into small portions and drying out by the next day.
Cake Stand and Accessory Hire
We offer cake stand hire in a range of colours, shapes and sizes. There is a hire fee for these items which will be separate on your order form. It is the customer’s responsibility to return hired items to our showroom within 5 days of the event. If you are going on honeymoon straight away, please ask a family member or friend to return it - let us know their name and contact number. Unless otherwise agreed, please ensure it is returned promptly as it may be needed for another wedding. If hired items are not returned within 5 days, or in the same good condition provided, you will be invoiced for a replacement. Cake stands and hoops vary between £45 and £100.
Allergies and Dietary Requirements
Our kitchen is not an allergy-free kitchen. Whilst we can discuss options for guests with intolerances, I do not offer cakes for people with food allergies. The following ingredients are used in our kitchen: Cereals containing gluten, eggs, milk, tree nuts, peanuts. The delivery form left with a member of staff will have an allergy sticker on it confirming these allergens are present in our kitchen. Charlotte Wilcox Cake Design will not assume any liability for adverse reactions to our products.
Some food colourings, including the red in our red velvet cake, may have an adverse effect on behaviour in children.
Fresh Flowers and Inedible Items
If you would prefer to use fresh flowers rather than sugar flowers, it is the customer’s responsibility to order these from your wedding florist. Please check that your florist will only provide non-toxic flowers. If in doubt, I reserve the right to refuse any flowers which may be toxic. There is a comprehensive list of poisonous flowers and foliage on the RHS website. By using fresh flowers on your cake, you acknowledge that they are not a food product and may contain pesticides, insects and/or other contaminants.
Certain elements of your cake design may be inedible. For example, sugar flowers may have a polystyrene bud and wire running through them and food safe plastic dowels are used to support each tier. Details of all items to be removed prior to serving will be given to a member of staff at your wedding venue.
Design and Colours
The sketch we provide to the customer is for reference only. Our cakes are all made by hand and so there may be slight variations in appearance on the finished product from the sketch and description. We endeavour to colour match as best we can using food safe ingredients. If you have a specific colour scheme, please provide a physical sample e.g. swatch of ribbon, paint colour card etc as colours sent via email can vary from screen to screen.
Charlotte Wilcox Cake Design reserves the right to photograph our cakes and use the images for display or promotion without compensation to you. Photos may be published on our website and social media channels, using the couples’ first names only. If you specifically do not wish us to use your names, please let us know in writing.
In any circumstance, Charlotte Wilcox Cake Design can only be held liable for an amount up to the total of the original order.
Any damage, contamination or loss of product after delivery is the responsibility of the customer/venue. Upon delivering a wedding cake to a venue, a member of staff will be asked to inspect the cake and sign to confirm it has been delivered in good condition. Charlotte Wilcox Cake Design cannot be held responsible for contamination or damage once it has been signed for.
If you wish to make a complaint to us or let us know any concerns after receiving the goods, please do so in writing. Evidence of any faults or damages should be included. If you are complaining and requesting a refund, then at least 75% of the uneaten product must be returned to us within 24 hours so we can fairly assess the complaint. Any refunds will be given entirely at our discretion.
All cake designs, logos and images are copyright to Charlotte Wilcox Cake Design and may only be used or reproduced with permission. Where images are used on our website, social media or promotional items that have been taken by a professional photographer, full credit will be given and the image remains their property.
